By accessing or using BestSpots ("the Platform"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Platform. These terms apply to all users including contributors, subscribers, and enterprise customers.
BestSpots is a marketplace for place-based information. Users can search for verified information about locations, contribute new information, prove existing information is accurate, and earn compensation based on the value their contributions generate. Enterprise customers may access aggregated data via API under a separate agreement.
You must create an account to contribute information or receive earnings. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account.
You must provide accurate information when registering. Impersonation of any person or organization is prohibited.

Violations may result in account suspension, forfeiture of pending earnings, and legal action where applicable.
Earnings are estimated based on our contribution pricing algorithm, which considers demand signals, information quality, contributor history, and platform revenue for the relevant area. Estimated earnings shown prior to payout are not guaranteed.
Payouts are processed via Stripe Connect. You must complete Stripe's identity verification to receive funds. BestSpots is not responsible for delays caused by Stripe or your financial institution.
We reserve the right to withhold or reverse payouts for contributions found to violate these Terms, including fraudulent presence verification or artificially boosted engagement.
Earnings may be subject to taxes in your jurisdiction. You are solely responsible for reporting and paying applicable taxes.
Subscription plans are billed on a recurring basis. You may cancel at any time; cancellation takes effect at the end of the current billing period. We do not offer refunds for partial billing periods except where required by law.
By submitting content to BestSpots, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and distribute that content as part of the platform and any derived data products. You retain ownership of original content you create. BestSpots retains ownership of its platform, algorithms, aggregated datasets, and all proprietary technology.
Presence verification uses your device's geolocation. Attempting to spoof, fake, or circumvent location verification is a material breach of these Terms and may result in permanent account termination and forfeiture of all pending earnings.
Enterprise data API access is governed by a separate Enterprise Agreement. Inquiries submitted via the Enterprise contact form do not constitute a binding agreement. API access will not be granted until an Enterprise Agreement is signed by both parties.
BestSpots provides place information "as is." We do not guarantee the accuracy, completeness, or timeliness of any information on the platform. Community-contributed content reflects individual user observations and may be outdated or incorrect. Do not rely solely on BestSpots information for safety-critical decisions.
To the maximum extent permitted by law, BestSpots shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the platform, including loss of earnings, data loss, or reliance on inaccurate information.
We may suspend or terminate your account at any time for violation of these Terms. You may delete your account at any time from the Account page. Upon termination, your right to use the platform ceases immediately. Pending earnings at the time of termination for cause may be forfeited.
These Terms are governed by the laws of the State of Texas, United States, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Travis County, Texas.
We may update these Terms at any time. Material changes will be communicated via email or in-app notice. Continued use after the effective date of changes constitutes acceptance.
